Doing business in Poland is regulated in the same way as in other European Union countries. It allows business activities to be conducted in various legal forms and on various bases including the freedom of services, and the freedom of establishment for entities among the EU states. Entities from outside the EU also have a very wide range of possibilities for conducting their business activities in Poland. Foreign investors who wish to conduct business in Poland may be required to meet certain conditions, obtain permits or licenses. These additional requirements are usually connected to the scope of activity to be undertaken, for example: banking, or insurance, etc. The forms and scope of conducting business in Poland, apart from general corporate issues, usually requires the involvement of tax, real estate, employment, and other areas of law. The video game industry has grown exponentially in the past few years, and its popularity shows no sign of slowing down. According to some of the market researchers, in 2023 the global video game market is projected to reach revenues of over US$370 billion. The COVID-19 pandemic has been a significant factor driving the industry’s growth, as more and more people are spending time at home and looking for new forms of entertainment. Additionally, mobile gaming has become an increasingly significant segment of the video game market, accounting for over 50 percent of current global game revenues. With the advent of new trends such as the metaverse, NFTs and blockchain gaming, we are observing video game sector clients continually exploring new ways to enhance the player experience. - Top 10 IP and TMT CJEU judgments of 2022 - What To Expect In 2023
Last year brought a number of interesting CJEU judgments that directly affect the fields of data protection, TMT and intellectual property. The decisions impact the application of current laws and give rise to new obligations for businesses. Dentons has compiled a list of the top 10 CJEU judgments that you need to know. In top position we have the dispute between Poland and the EU Parliament with regard to Online Content Sharing Service Providers. Sharing the podium are the SpaceNet and RTL Television cases, which touch upon well-known aspects of traffic and location data retention and, respectively, the transmission of television programs in hotel rooms. Other judgments deal with crucial issues such as data storage – either for creating error-detection databases or in the context of market-crime detection – cloud services as well as processing of extra-sensitive personal information. Three cases are discussed that relate to intellectual property laws, including Austro Mechana and Koch Media. - Energy price caps and other emergency interventions in the electricity market in Poland in 2023
As a sharp increase in energy prices has been observed in recent months, the Polish Parliament, following the Council of the European Union, introduced a new emergency intervention in the electricity market to protect end-users and businesses from potential harm due to the current unstable situation. Energy price caps for specific eligible offtakers, mechanisms for redistributing excess profits of energy producers and instruments promoting a reduction in electricity demand have been adopted.
