The accused in this case was a captain of the Polish Army Reserve. He had been released from active duties and was on extended leave. He was discharged, after having pleaded guilty, under the Probation of Offenders Act, 1907, at Marlborough Street Police Court, London, on the 13th February, 1941, on the charge of stealing, on the 5th February, 1941, in a shop in London, various articles to the value of six shillings. Subsequently the Polish military authorities directed the case to the Polish Court Martial.
