Summary: The facts:—Bartholomeus T., a native of the former Mandated Territory of South-West Africa (now Namibia) and a political refugee from that Territory, had been staying in Poland since 1965. He possessed an identity document issued by the authorities of Tanzania and valid for one foreign trip. He intended to marry a Polish citizen, but he was unable to submit a certificate showing that he had the capacity to contract a marriage. Polish law provides for dispensation with this requirement in exceptional cases. Accordingly, Bartholomeus T. requested the District Court in Cracow to grant him such a dispensation.
